Carnegie Open... For Now

No park closure until January 11

The following is from D-36...

All - An update on the CARNEGIE issue. Carnegie to stay OPEN until 1/11/2010 pending further legal action.
Today, a huge rally took place at CARNEGIE State Vehicle Recreation Area. Hundreds, if not thousands of OHV enthusiasts were on hand, as well as the news media. It appears to be a great success.

Now, an update:
Effective TODAY, late in the afternoon, the APPEALS COURT for this jurisdiction GRANTED a STAY in our favor, and the park will NOT BE CLOSED at least until January 11, 2009 pending the accepted appeal put forth by State Parks/OHMVRD. This opens all kinds of doors for new information to be submitted to the court, including Lawrence Livermore Lab Site 300 (EPA Superfund Site) and Hetch Hetchy Water and the slamming they got from the very same Central Valley Water Quality Control Board. Additionally, the Tesla Mine, the first working coal mine in CA can be introduced as evidence for pollutants, as well as other water quality testing that we can do to dispute what PEER & SFA supplied. Also, all discovery and forced documentation of claims made by the Plaintiffs. All of this information was ignored by the original Judge. Also, this allows testimony by the CVWQCB to be subpoenaed, and can tell the appeals court that they IN FACT have been working side by side with Parks for resolution to the issues going back 8 years.
